逞口舌之快,沒兌現承諾,沒有誠信,變成放羊的孩子就該下台。

食言而『肥』,就是一種『貪污』。

這是放諸四海皆準,連小朋友都懂的道理。

土匪霸佔你家,你去叫土匪收留你,你等於是把命交給土匪,任何土匪宰割。

同理,中國土匪霸佔台灣,台灣人去叫中國土匪收留台灣人,台灣人等於是把命交給中國土匪,任由中國土匪宰割。
1945﹣1952 台灣是戰敗國日本的領土,是盟軍的佔領地。

中國土匪違反海牙公約45條(http://www.oceantaiwan.com/eyereach/20061216.htm):
【第 45 條】
 禁止強迫佔領地的住民宣誓效忠敵對國。

1945/10/25 中國土匪宣佈台灣光復,強迫佔領地台灣的人民效忠中國土匪,是戰爭罪。

佔領地的人民必須自己組成自己的政府,保護自己佔領地的人民,而不是跑去跟佔領者搞在一起。

總之,台灣人是佔領地的人民,必須脫離佔領者中華民國,自組民政府。

二戰後,美國佔領日本,日本人如果跑去當美國人,就會像台灣一樣,無法恢復國際地位。

全世界被佔領地的人民都不會跑去當佔領方的人民,就唯有台灣人跑去當佔領方的人民。

真不知該如何說才好。

台灣人通通脫離中華民國!!!

3. What are the most important principles governing occupation?  

The duties of the occupying power are spelled out primarily in the 1907 Hague Regulations (arts 42-56) and the Fourth Geneva Convention (GC IV, art. 27-34 and 47-78), as well as in certain provisions of Additional Protocol I and customary international humanitarian law.

Agreements concluded between the occupying power and the local authorities cannot deprive the population of occupied territory of the protection afforded by international humanitarian law (GC IV, art. 47) and protected persons themselves can in no circumstances renounce their rights (GC IV, art. 8).

The main rules o f the law applicable in case of occupation state that:

1. What is occupation? 何謂佔領?
Article 42 of the 1907 Hague Regulations (HR) states that a " territory is considered occupied when it is actually placed under the authority of the hostile army".  1907年海牙公約第42條說到,當戰鬥軍隊當局實際掌控領土時,即進入領土之佔領。The occupation extends only to the territory where such authority has been established and can be exercised. " 佔領只延伸到該當局已經設立及運作的領土。


According to their common Article 2, the four Geneva Conventions of 1949 apply to any territory occupied during international hostilities.  根據第2條,1949年第四日內瓦公約可適用到任何國際戰鬥時之佔領地。They also apply in situations where the occupation of state territory meets with no armed resistance. 他們亦適用於無軍隊抵抗之國家領土之佔領情況。


The legality of any particular occupation is regulated by the UN Charter and the law known as jus ad bellum.  聯合國憲章及熟知戰爭正當性jus ad bellum法律規定任何特殊佔領之合法性。Once a situation exists which factually amounts to an occupation the law of occupation applies – whether or not the occupation is considered lawful.  不管佔領之合法性,一旦存在實際上相當於佔領之情況,佔領法律即適用。

Therefore, for the applicability of the law of occupation, it makes no difference whether an occupation has received Security Council approval, what its aim is, or indeed whether it is called an “invasion”, “liberation”, “administration” or “occupation”.   因此,儘管佔領已經獲安理會核准,其目的為,或實際上被稱作是『侵略』『解放』『監管』或『佔領』,就佔領法之適用性而言,並無不同,As the law of occupation is primarily motivated by humanitarian considerations, it is solely the facts on the ground that determine its application. 當以人道考量為主啟動佔領法時,完全視當地的實際情況而決定其適用。


Once a situation exists which factually amounts to an occupation the law of occupation applies – whether or not the occupation is considered lawful.  不管佔領之合法性,一旦存在實際上相當於佔領之情況,佔領法律即適用。

2. When does the law of occupation start to apply?

The rules of international humanitarian law relevant to occupied territories become applicable whenever territory comes under the effective control of hostile foreign armed forces, even if the occupation meets no armed resistance and there is no fighting.

無論何時領土置於戰鬥外國軍隊勢力之有效控制下運作,甚至佔領無遭遇任何軍隊抵抗及無任何戰事,佔領地即適用國際人道法律之規定。


The question of " control " calls up at least two different interpretations.
控制的問題至少有二種不同的解釋。

 It could be taken to mean that a situation of occupation exists whenever a party to a conflict exercises some level of authority or control within foreign territory.
它意謂著一種佔領存在的情況,無論何時,衝突之一方在外國領土內運作某些程度之權力當局或控制。

So, for example, advancing troops could be considered bound by the law of occupation already during the invasion phase of hostilities.

This is the approach suggested in the ICRC's Commentary to the Fourth Geneva Convention (1958).

An alternative and more restrictive approach would be to say that a situation of occupation exists only once a party to a conflict is in a position to exercise sufficient authority over enemy territory to enable it to discharge all of the duties imposed by the law of occupation. 4. What rights does the occupying power have regarding property and natural resources in the occupied territory?

Private property
私人財產


Private property cannot be confiscated by the occupier.
佔領者不可沒收私人財產。

Food and medical supplies may be requisitioned exclusively for the use of the occupation forces and administration personnel themselves (i.e. not for purposes of export outside of the occupied territory and not for the benefit of anyone beyond the occupying personnel, unless necessary for the benefit of the population under occupation itself) and only if the needs of the civilian population have been taken into account (GC IV, art. 55).
可專門為佔領軍及監督人員自己之使用而徵用食物及醫療供應,(亦即,不可輸出到佔領地之外,及不可圖利佔領人員外的任何人,除菲佔領地人民需要之利益),並且必須考慮到佔領地人民之需要。

Public property
公共財產


The occupying power may seize any movable property, belonging to the state, which may be used for military operations (HR, art. 53).
佔領者可以利用軍事力量,沒收該國家『可移動的財產』。

The occupant does not acquire ownership of immovable public property in the occupied territory, since it is only a temporary administrator.
佔領者只是一個短期監管者,因此不能獲得佔領地之公共不動產的所有權。

Subject to restrictions regarding their exploitation and use, it can nevertheless make use of public property, including natural resources, but it must safeguard their capital value, in accordance with the law of usufruct (H R, art. 55).

視開發及使用限制的情況而定,佔領者仍然可以使用公共財產,包含天然資源,但佔領者必須保障他們的基本價值,根據使用權的法律(海牙公約第55條)。

現在要真正喚起多數本土臺灣人是皇民後裔的事實,特別是在連戰、郝伯村對“青山文哲”的攻擊之後,要趁勝追擊,讓本土臺灣人正視這個身份。

 

在國民黨的洗腦教育下,多數本土臺灣人錯認祖先在二次大戰時立場和角色。

 

蔣友柏曾經以身為蔣家後代為蔣家對臺灣人的白色恐怖道歉,換來的是一種讚賞,到現在也沒多少人把他和蔣家綁在一起,因為他的策略成功了,卻惹來國民黨內部非議。

 

同樣的,臺灣假如大規模舉辦二次大戰期間身為大日本帝國子民後裔對戰爭的“省思”,相信也會產生很大效果,特別是能挑起在臺灣身份認同,也會深深刺痛那些中國流亡難民,但是這樣的省思,也一定會招來不願面對真相的人攻擊,特別是現在中國流亡政府對“皇民”的汙名化。到時產生的效應絕對是巨大的,可以參考柯文哲的聲勢。

 

這只是為了加速激起本土臺灣人的身份認同的策略,不需要過度解釋,相信也能加速民政府的執政。
