大選前，2012年1月13日，美國國防部東亞副助理部長薛邁龍(Michael Schiffer)與南亞及東南亞副助理部長謝爾(Robert Scher)，兩人在五角大廈舉行記者會，會中針對記者三度詢問台灣大選結果，對兩岸關係所可能造成之影響？薛邁龍一再回應：「不評論台灣政治與民主選舉過程，期待結果揭曉。」
 
大選後，2012年1月14日，在美國當局所定位之所謂「台灣大選」結果揭曉，美國國務院方面隨即發表聲明恭喜馬總統勝選(The United States congratulates President Ma on his victory in Saturday’s elections in Taiwan)。白宮方面也是隨即發表聲明，恭喜馬英九連任(We congratulate Ma Ying-jeou on his reelection)，至於在選前期待結果揭曉之美國國防部方面，未發表任何聲明。
 
同樣是從屬於美國總統之政府機關，美國國務院是以美國外交部門之立場，恭喜傳統友邦流亡中華民國馬總統勝選。至於美國國防部，則是聽命於兼任美軍統帥之美國總統，並無立場逕行發佈祝賀聲明，而是由白宮新聞秘書處發佈總統聲明恭喜馬英九勝選。流亡中華民國總統其實是在舊金山和平條約第23條(a)架構內，在美國總統默認下，得以兼任台灣治理當局行政長官，以代理美國軍事政府占領日本台灣。
 
然而，本土台灣人從未要求美國國防部，應比照美軍在占領照琉球期間，以琉球列島「美國軍政本部或美國民政府」名義，核發旅行證明書予琉球住民之模式，以美國軍事政府名義，核發旅行證明書予本土台灣人。
 
中國殖民政權確實是代理美國軍事政府占領日本台灣，然而，本土台灣人並無法期待由流亡中華民國總統所兼任之台灣行政長官，會依照代理法原則，以美國軍事政府名義，核發旅行證件予本土台灣人。
 
實際上，依戰爭法原則：

The instituting military government in any country by the commander of a foreign army is incidental to the state of war, and appertains to the law of nations.外國軍隊指揮官，在任何國家設立軍事政府，是隨附於戰爭狀態而從屬於萬國公法。

 
美國總統應心裡有數，基於「軍事占領不得移轉主權」而且「流亡政府不得就地合法」之國際法則，處於法理無國籍狀態之被占領方本土台灣人，持中華民國護照出入台灣，根本就是違反代理法及美國憲法所承認之萬國公法。
 
基於日本台灣之領土主權並不歸屬美國，本土台灣人不是向「美國地方法院」訴請「美國國務院」核發「美國國民護照」，而應是向」美國軍事法庭」訴請「美國國防部」，比照琉球列島以「美國軍政本部或美國民政府」名義，核發旅行證明書予琉球住民之模式，根據「台灣民政府」所核發之「台灣政府身分證」，親自核發具有「身分證明(Certificate of Identity)」功能之美國軍事政府旅行證明書予本土台灣人。

（中央社記者廖漢原華盛頓13日專電）美國國防部今天舉行記者會說明亞洲軍事策略，對於台灣正在舉行的總統大選，官員指出，「不評論台灣政治與民主選舉過程，期待選舉結果揭曉。」
 
美國國防部東亞副助理部長薛邁龍（Michael Schiffer）與南亞及東南亞副助理部長謝爾（Robert Scher）在五角大廈舉行記者會，對於記者3度詢問台灣總統大選結果可能影響兩岸關係，薛邁龍多次回應「不評論台灣政治與民主選舉過程，期待結果揭曉。」
 
美國國防部上週公布軍事指導原則，被問及對未來台海重要性及佈局的可能影響，薛邁龍指出，「過去多年來，台海穩定對美國國家安全至關重要，美國根據一中原則、台灣關係法與美中三項聯合公報擬定台海策略。」
 
薛邁龍說，「美國歡迎過去幾年，台北與北京逐步進行雙邊交流，未來也樂於對兩岸穩定提供協助。」
 
他並強調，不評論台灣民主選舉程序，國防部一如過往期待最後結果。
 
根據美國國防部公布的未來10年國防指導原則，美軍將國防重心移轉至西太平洋地區，加強與盟邦和夥伴國家如日本、南韓、澳洲、印度的軍事合作，並以中國大陸和伊朗為假想敵。
 
謝爾在記者會強調，美國依國際公約與南海主權歸屬未定的原則，與中國大陸尋求合作，美方不會偏袒任何一方，以維持航道暢通。

The Americans continue to indulge the fantasy that the Chinese are becoming a democracy. Discos to democracy notion permeate the politics of the Beltway and Taipei for China policy.
 
Taiwan democracy is their natural justification for the handover of the island to China by Ma. It is natural. It is normal. It is Machiavellian.  Ma is validating the DC grand design on China.
 
The WTO market reforms that just won't take root just need another stimulus package called Taiwan. Sacrificing the island on the altar of free-trade means that the Taiwan unification is looming.
 
Ma has a voter mandate to mend fences with Beijing.  Afterall, you are really just Chinese. Sino-centric policies will steer the Taiwan Question towards China.  
 
The Greens are on sinking ship.  They'll never reverse the ship of state or stall the KMT now. Unless the Tsai due diligence on defacto standards of independence are dusted off, it is over. The WTO is the master plan for market reforms of China.
 
WTO are your brakes on reunification. The USMG concept serves for the quasi-trusteeship of Taiwan self-governing customs territory.
 
The fundamental problem of Lin v United States is they did not argue for this travel document.
 
They wanted to play fait accompli games with the courts and the got called out on it in public.
 
Political purgatory is also the result of the court also ratting out the federal government, too.
